Summary
When you place your order for the Goods, you will be asked to first confirm that you have read, understand and agree to the Terms and Conditions of Sale.
The Consumer Protection (Distance Selling) Regulations 2000 allow the Buyer to cancel the contract for the Goods, without giving reason, at any time before the end of 7 working days after delivery. However, this right does not apply in the case of any Goods which are specially made to the individual requirements of the Buyer.  Any Goods that consist of prescription eyewear falls within this exclusion, the right to cancel the Contract for prescription eyewear Goods, without giving reason, therefore does not apply to prescription spectacles, prescription sunglasses, prescription sportswear products and prescription swimming goggles, which are made to the special requirements of the Buyer.
Paul Roche Eyewear Ltd. offers a 14 day money back guarantee and a 12 months manufacturer’s product guarantee on faulty workmanship subject to the Terms and Conditions of Sale described below.

Terms and Conditions of Sale
1             The Contract      These Terms and Conditions of Sale apply to the sale of any product ( the Goods ) by Paul Roche Eyewear Ltd. to a customer ( the Buyer ).  Paul Roche Eyewear Ltd. and the Buyer are referred to together as the Parties.
The Contract Documents will consist of:

  • The Order ( the Goods )
  • Paul Roche Eyewear Ltd.   Acceptance of the Order
  • The Terms and Conditions of Sale

The Contract Price will be the price of the Goods and the delivery charge as stated on the order, plus VAT where applicable. The Buyer will be required to pay the Contract Price in full before the Goods are dispatched to the Buyer.
2            Acceptance of an Order                For the purpose of Contract law, the advertising or display of the Goods on Paul Roche Eyewear Ltd. website ( the Website )  is not an offer for sale but an invitation to a prospective Buyer to offer to buy the Goods. The Order is treated as an offer to buy the Goods stated in the Order. The Parties do not enter into a Contract until Paul Roche Eyewear Ltd. Accepts the Order.
a             For the purposes of clarification, a  Confirmation that the Order has been received will be sent to the Buyer  by email at the time the Buyer submits his/her Order electronically over the internet via the Paul Roche Eyewear Ltd. website. This Confirmation that the Order has been received will not be the Acceptance of the Order by Paul Roche Eyewear Ltd. but will be treated as an offer to buy the Goods stated in the Order.
The Confirmation that the Order has been received Documents will consist of:

  • The Order ( the Goods )
  • Paul Roche Eyewear Ltd.   Confirmation of Receipt of the Order
  • The Terms and Conditions of Sale

b             Paul Roche Eyewear Ltd. is owned and staffed by professionally qualified opticians. Our staff will review the offer to buy as contained in the Order and reserve the right to respond to the Buyer offering professional advice regarding the details of the Order.
c             For the purposes of clarification, Paul Roche Eyewear Ltd. has not accepted the offer to buy the Goods described in the Order until  Paul Roche Eyewear Ltd sends the following Contract Documents (Also see Paragraph 3 below ) by email, or some other method, to the Buyer 
Contract Documents      The Contract will consist of:        
a     The Order ( the Goods )
b     Paul Roche Eyewear Ltd.  Acceptance of the Order received
c      The Terms and Conditions of Sale

d             For the purposes of clarification, Paul Roche Eyewear Ltd. reserves the right to reject the Buyers offer to buy the Goods described in the Order after having sent the ‘Confirmation that the Order has been received Documents’.
e             In the event that Paul Roche Eyewear Ltd. does not accept the offer to buy the Goods described in Order and in the ‘Confirmation that the Order has been Received Documents’, any monies paid by the prospective Buyer will be return in full. 

3             Contract Documents      The Contract will consist of:        
a     The Order ( the Goods )
b     Paul Roche Eyewear Ltd.  Acceptance of the Order received
c      The Terms and Conditions of Sale

If the Buyer wishes to cancel or to change any conditions of the Order, the Buyer must contact Paul Roche Eyewear Ltd. immediately by email or phone after receiving the ‘Confirmation that the Order has been Received Documents’.

a             Once Paul Roche Eyewear Ltd. has sent notice of ‘Acceptance of the Order Received’. If the Buyer then wishes to change any details of the Order, any change will be a variation to the Contract which will require the agreement of Paul Roche Eyewear Ltd. 

4             Status of Buyer The Buyer must be 18 years of age or over. In addition to this, the Buyer agrees with Paul Roche Eyewear Ltd.  (by entering into a Contract with Paul Roche Eyewear Ltd.)  that the Buyer is not registered blind or partially sighted and that the Buyer is not acting on behalf of any person who is blind or partially sighted or who is 16 years old or younger.

5             Description of Goods      The Goods are as described on the Paul Roche Eyewear Ltd. website. For the purposes of the Contract, the Goods will be described in the Order.

6             Prescriptions for the Glazing of Spectacle Lenses               When the Order includes prescription eyewear products, the Buyer agrees to provide Paul Roche Eyewear Ltd. with complete and accurate details of their spectacle prescription for each lens and that all details and notes have been included with the spectacle prescription as given to the Buyer by the Registered Medical practitioner, Registered Ophthalmic optician or Registered Optometrist ( hereafter called Registered Practitioner ).  The Buyer agrees to provide Paul Roche Eyewear Ltd. , with an original copy of the spectacle prescription used ( including all details and notes from the Registered Practitioner ), if requested,  at any stage during the performance of the Contract.

a             The Buyer confirms that the spectacle prescription given with their Order is less than 2 years old and that the Buyer has provided an accurate PD ( pupil distance ) measurement to Paul Roche Eyewear Ltd. for the prescription eyewear product Order. 
b             The Buyer agrees with Paul Roche Eyewear Ltd. by entering into a Contract to purchase their Order, that their Status as the Buyer conforms to Paragraph 4 above

7             Changes in Advertised Prices      The prices stated for the products displayed in the Paul Roche Eyewear Ltd website are subject to change at any time.      
 
8             Contract Price    The Contract Price will be the price of the Goods as stated on the Paul Roche Eyewear Ltd. website at the time the Buyer places the Order, plus delivery charges plus VAT prevailing at the time and where applicable.

9             Payment             The Buyer agrees to pay the Contract Price in full in cleared funds before the Goods are dispatched to the Buyer. 
a             Payment is by credit/debit card only
b             All prices are inclusive of VAT at the prevailing rate and where applicable
c             The Goods can only be delivered to the registered address on the credit card or debit card used for payment
d             The Goods remain the property of Paul Roche Eyewear Ltd. until paid for in full
e             By placing an Order, you agree to receive emails and other promotion materials. You can choose to cancel this at any time by notifying us by email.

10           Availability of Goods Advertised               All products advertised on Paul Roche eyewear Ltd. website are subject to availability. Paul Roche Eyewear Ltd. reserves the right to cancel the Order placed by the Buyer, making a full repayment of all monies paid by the Buyer, if at any time during the performance of the Contract either the frame advertised ( forming part of the Order ) is no-longer available  or one or both prescription lenses ( forming part of the Order ) is/are no-longer available.
a             In the event that a frame or a lens forming part of the Order is no-longer available Paul Roche Eyewear Ltd. will offer the Buyer an alternative product. The Buyer is under no obligation to accept the alternative product and is entitled to a full refund of all monies paid.

11           Modifications to Individual Frame Model Styles Made by the Manufacturer   Manufacturers of spectacle frames make design modification changes to their individual frame models from time to time. Paul Roche Eyewear Ltd. cannot be held liable for the manufacturers’ modifications to their individual frame models from time to time.  All reasonable effort will be made by Paul Roche Eyewear Ltd. to ensure that the frame model displayed on the website is consistent with the frame model supplied by the manufacturer at the time the Buyer places the Order. However, the Buyer agrees with Paul Roche Eyewear Ltd. that Paul Roche Eyewear Ltd. shall not be held liable for any frame model modification made by the manufacturer that may be substituted for or may occur from time to time.

12           Delivery and Delivery Date           Any delivery date given or implied at the time the Order is placed is an estimate only. Paul Roche Eyewear Ltd. will take all reasonable steps to ensure that the Goods are delivered to the Buyer within 30 days after acceptance of the Order.

a             If during the course of the preparation of the Goods a delay is incurred and the delivery date will exceed 30 days, Paul Roche Eyewear Ltd. will contact the Buyer and inform him/her of the delay.
b             If the Buyer is not willing to agree to the extension beyond the 30 days, the Buyer is entitled to a full refund of all the monies paid.
c             The Goods can only be delivered to an address in the UK
d             The Goods can only be delivered to the registered address of the credit card or debit card used for the payment.
e             The Buyer agrees to inform Paul Roche Eyewear Ltd. if the Goods are not delivered by the expected date.

13           Ownership and Risk        All risk as to loss or damage to the Goods and legal ownership of the Goods pass to the Buyer on delivery of the Goods to the address given on the Order.

a             We advise that you inspect the Goods upon delivery and notify us immediately by email should they in any way be defective or inconsistent with your Order.
b             Should the Goods appear to be defective the Buyer agrees with Paul Roche Eyewear Ltd. not to use the Goods.

14             Returns Policy                The Consumer Protection (Distance Selling) Regulations 2000 allow the Buyer to cancel the contract for the Goods, without giving reason, at any time before the end of 7 working days after delivery. However, this right does not apply in the case of any Goods which are specially made to the individual requirements of the Buyer.  As prescription eyewear products fall within this exclusion, the right to cancel the Contract for prescription eyewear Goods, without giving reason, therefore does not apply to prescription spectacles, prescription sunglasses, prescription sportswear products and prescription swimming goggles, which are made to the special requirements of the Buyer. In the case of a defect in any Goods, the Buyer will be entitled to a refund in accordance with Paragraph  15 of the Terms and Conditions of Sale.
              
a             If the Buyer wishes to return the Goods for any other reason other than due to Defect, Paragraph 16 of the Terms of Conditions of Sale will apply.

15           Returns of Defective Goods         Defective Goods must be returned unused and in the same condition as received. All original packaging must be returned undamaged. Defective Goods must be returned within 7 working days of delivery.

a             The Buyer agrees with Paul Roche Eyewear Ltd. not to use or to wear the defective Goods.
b             The Buyer agrees to contact Paul Roche Eyewear Ltd. immediately upon receipt of any defective Goods. Contact can be made by email, phone, or fax. The Buyer will be given a Returns Code.
c             The Buyer agrees to include within the returns packaging clear reasons why the Buyer believes the Goods to be defective.
d             The Buyer agrees that Paul Roche Eyewear Ltd. has the right to appeal to a qualified independent assessor in the event of any disagreement between the Parties regarding the Goods being defective.
e             Paul Roche Eyewear Ltd. agrees with the Buyer that:

  • Defective Goods are Goods that have prescription lenses that have been glazed incorrectly to the spectacle prescription supplied by the Buyer at the time of the Order.
  • Defective Goods are frames that are different from those specified in the Order.
  • Defective Goods are materials that are defective in its manufacture and are not fit for purpose.
  • Defective Goods are frames that are different in their overall width or in the length of the sides to those chosen at the time of the Order.  

e             When Paul Roche Eyewear Ltd. has received the Defective Goods and once full agreement between the Parties has been reached that the Goods are defective under  (d) above.

  • Paul Roche Eyewear Ltd will offer the Buyer to replace the Goods or to repair the Goods or to give a full refund.
  • Refunds will be made by the dame method of payment made by the Buyer when paying for the original Order.

16           Return of Goods Not Wanted     The Consumer Protection (Distance Selling) Regulations 2000 allow the Buyer to cancel the contract for the Goods, without giving reason, at any time before the end of 7 working days after delivery. However, this right does not apply in the case of any Goods which are specially made to the individual requirements of the Buyer.
Prescription eyewear products fall within this exclusion.   
               However, Paul Roche Eyewear Ltd. agrees with the Buyer to accept the cancellation of the Contract at any time before the end of 14 working days after delivery and receive the return of the Goods not wanted under the following conditions:-

a             The Buyer agrees not to use the Goods  he/she wishes to return not wanted.
b             The Buyer returns all of the Goods not wanted undamaged and with all the packaging undamaged.
c             All risk as to loss or damage of the Goods remain with the Buyer until the Goods not wanted are safely received by Paul Roche Eyewear Ltd.
d             All costs incurred in the packaging and the delivery of the Goods not wanted is born by the Buyer.
e             The Buyer agrees with Paul Roche Eyewear Ltd. that all the reasonable costs incurred by Paul Roche Eyewear Ltd.  in the supply of and in the glazing of the individual prescription lenses in the Order of the Goods not wanted can be deducted from the Contract Price before the balance of the Contract Price is refunded to the Buyer.

17         Liability                Paul Roche Eyewear Ltd. will not be liable for any visual problems, loss of any nature, accident or injury, indirect losses or any third party injury or losses that may occur as a result of any incorrect information supplied by the Buyer or by the Buyer’s Registered Practitioner,  Paragraph 6.

a             In the case of any defect in the Goods, where no injury is caused and subject to the above, the liability of Paul Roche Eyewear Ltd. will be limited to the amounts described under Paragraph 15
b             In the case of any defect in the Goods, the Buyer agrees with Paul Roche Eyewear Ltd. that Paul Roche Eyewear Ltd. is not liable for any indirect loss such as any additional costs incurred by the Buyer in obtaining another product from another source, or any other loss or expense incurred by the Buyer by being prevented from using the Goods from the expected date of delivery or at any time after that date. 
c             All of the prescription eyewear products and frame materials are as described on the Paul Roche Eyewear ltd. website. The Buyer agrees with Paul Roche Eyewear ltd. that the eyewear products and frames described as ‘Metal’ on the Paul Roche Eyewear Ltd. website may contain nickel alloys.
d             The Buyer agrees with Paul Roche Eyewear Ltd. that the prescription eyewear products and frames displayed on the Paul Roche Eyewear ltd. website are not supplied as ‘non-allergenic’ eyewear products and frames, unless this is specifically stated on the Order. The Buyer agrees with Paul Roche Eyewear Ltd. to accept full responsibility for choosing their eyewear products and frames based upon the descriptions and the information supplied on the Paul Roche Eyewear Ltd. website. 

18           Guarantee          Paul Roche Eyewear Ltd.  offer a  14 day money back guarantee for Goods not wanted subject to Paragraph 16 above.  In the event of a fault developing in the Goods over time,  the following conditions will apply.

a             Paul Roche Eyewear Ltd.  prescription eyewear products have a 12 month manufacturer’s guarantee against faulty workmanship. To claim under this guarantee the Buyer agrees to contact Paul Roche Eyewear by email or letter stating clearly the nature of the fault and to obtain a Returns Code. Paul Roche Eyewear Ltd. reserves the right to repair or to replace faulty Goods at our discretion.
b             The manufacturer’s guarantee against faulty workmanship will not apply where the Goods have been subject to misuse, have not been used for the intended purpose or have not been used or cared for in accordance with any instructions given with the Goods.
c             The manufacturer’s guarantee against faulty workmanship will not apply where the Order does not comply with Paragraph 6 above.  

19           Third Parties       No person other than Paul Roche Eyewear Ltd. and the Buyer has any right to enforce the Contract under the provisions of the Contracts ( Rights of Third Parties ) Act 1999.

20           General              

a             No employee or agent of Paul Roche Eyewear Ltd. has the right to vary these Terms and Conditions of Sale.
b             These Terms and Conditions of Sale shall be governed by English Law
c             Paul Roche Eyewear Ltd. reserves the right to Cancel the Order at any time with the Buyer if Paragraph 4 and/ or Paragraph 6 are contravened and to deduct any reasonable costs incurred by Paul Roche Eyewear Ltd. in the preparation of the Order prior to cancellation.
d             A binding Contract is only entered into between the Parties when Paul Roche Eyewear Ltd.  sends notification of the  ‘Acceptance of the Order Received’  Contract Documents as described under Paragraph 3 above.
e             Nothing in these Terms and Conditions of Sale shall effect your statutory rights.
